They are not one: the Trademark Office is subordinate to the State Administration for Industry and Commerce, and is in charge of trademark registration and management throughout the country. It is responsible for the registration of trademarks such as commodity trademarks, service trademarks, collective trademarks, certification trademarks, etc., handling trademark objection rulings and related matters such as the change, transfer, renewal, replacement and cancellation of registered trademarks, guiding, coordinating and organizing local industrial and commercial administrations to investigate and deal with trademark infringement and counterfeiting cases, and identifying and protecting well-known trademarks according to law. Supervise and manage trademark agencies, study and formulate rules and regulations for trademark registration and management, and specific measures and methods, organize the specific implementation of international treaties and agreements on trademarks in China, and undertake the related work of international exchange and cooperation on trademarks. The Trademark Review and Adjudication Board is an administrative law enforcement agency. However, according to the law, the Trademark Review and Adjudication Board independently exercises the adjudication power on trademark review matters, and is not affected by administrative or other factors. Except as otherwise provided by law, the Trademark Review and Adjudication Board adopts a collegiate bench system when trying trademark dispute cases, and the collegiate bench is composed of trademark reviewers. The collegiate bench shall practise the principle that the minority is subordinate to the majority when trying cases.
