It's easy to answer the question of what the industrial injury insurance fund and the enterprise need to pay respectively, but you can't answer how much if you don't know the level of disability. The following answers are for reference:
(1) Payment from work-related injury insurance fund:
1. Medical treatment: If the expenses required for the treatment of work-related injuries meet the catalogue of work-related injury insurance diagnosis and treatment items, the catalogue of work-related injury insurance drugs and the hospitalization service standards of work-related injury insurance, the hospitalization food subsidy will be paid according to local standards.
2. Life care fees are paid according to three different levels: life can't take care of itself at all, most of life can't take care of itself, or some of life can't take care of itself. The standards are 5%, 4% or 3% of the average monthly salary of employees in the overall planning area respectively.
3. One-time disability allowance: the standard is: my salary of 27 months for first-degree disability, 25 months for second-degree disability, 23 months for third-degree disability and 21 months for fourth-degree disability; Grade five disability is my salary for 18 months, and grade six disability is my salary for 16 months; Seven disability is my salary for 13 months, eight disability is my salary for 11 months, nine disability is my salary for 9 months, and ten disability is my salary for 7 months.
4. Disability allowance for level 4 disability: the standard is: 9% of my salary for level 1 disability, 85% for level 2 disability, 8% for level 3 disability and 75% for level 4 disability. If the actual amount of disability allowance is lower than the local minimum wage, the industrial injury insurance fund will make up the difference.
5. If the level 5 to 1 disability is terminated, a one-time medical subsidy for work-related injuries shall be paid according to the local standard.
(II) Payment by enterprises:
1. Medical treatment: The expenses for treating work-related injuries are generally paid by the unit outside the catalogue of work-related injury insurance. If the unit needs nursing, the unit needs to pay the nursing expenses according to local standards.
2. Treatment of downtime with pay: it is necessary to determine the downtime with pay for the treatment of work-related injuries. Usually, the medical institution that treats work-related injuries gives opinions and is confirmed by the labor ability appraisal committee. Generally, it does not exceed 12 months. If the injury is serious or special, you can apply for an extension. After confirmation by the labor ability appraisal committee, the maximum extension is 12 months. The specific procedures for determining the period of shutdown with pay shall be implemented according to local regulations. The original wages and benefits will remain unchanged during the period of shutdown with pay, and will be paid by the unit monthly.
3. The nursing expenses needed by the injured workers who can't take care of themselves during the shutdown with pay.
4. Disability allowance for level 5 and level 6 disability: the standard is: level 5 disability is 7% of my salary, level 6 disability is 6% of my salary. If the actual amount of disability allowance is lower than the local minimum wage, the employer will make up the difference.
4. If the labor relationship is terminated, the work-related injury insurance fund will pay the one-time medical subsidy for work-related injuries, and the unit will pay the one-time disability employment subsidy. Standards vary from place to place. I wonder where you are.
5. If the level 5 to 1 disability is terminated, a one-time disability employment subsidy shall be paid according to the local standard.
