The representative offices of foundations and overseas foundations are obligors of information disclosure. Article 3 The information released by the information disclosure obligor shall be true, accurate and complete, and there shall be no false records, misleading statements or major omissions.
The information disclosure obligor shall ensure that donors and the public can consult or copy the published information quickly and conveniently. Article 4 The information that an information disclosure obligor should disclose to the public includes:
(a) the annual work report of the foundation and the representative offices of overseas foundations;
(2) The fund-raising activities organized by the public offering foundation;
(3) Information on projects funded by public welfare foundations.
On the basis of observing the provisions of these Measures, the representative offices of foundations and overseas foundations may decide to release more information at their own discretion. Article 5 An information disclosure obligor shall submit the annual work report of the previous year to the registration authority before March 3 1 every year. Within 30 days after the approval of the registration agency, the information disclosure obligor shall publish the full text and abstract of the annual work report in the media designated by the registration agency in accordance with the requirements of a unified format.
The financial and accounting reports of information disclosure obligors shall not be published to the public without audit. Article 6 When organizing fund-raising activities, a public offering foundation shall announce the public welfare activities to be carried out after fund-raising and the detailed plan for the use of funds. During the duration of fund-raising activities, the income obtained from fund-raising activities and the expenses for carrying out public welfare activities shall be announced in a timely manner. After the fund-raising activities, all the income obtained from the fund-raising activities and their uses shall be announced. Article 7 When a foundation carries out public welfare funded projects, it shall announce the types of public welfare projects and the application and evaluation procedures. After the examination, the examination results shall be published and the applicant shall be notified. After the completion of the public welfare funded project, the relevant use of funds shall be announced. Post-evaluation of the project shall be announced at the same time. Article 8 An information disclosure obligor shall publicly explain or clarify the news appearing in the public media that has or may have adverse effects on the information disclosure obligor. Article 9 In addition to the annual work report, the information disclosure obligor may choose newspapers, radio, television or the Internet as the media for releasing information. Article 10 The media used for information disclosure shall be able to cover the activity area of the information disclosure obligor. The information released shall indicate the basic information of the information disclosure obligor and the contact and consultation methods. Article 11 An information disclosure obligor shall establish and improve the internal management system of information disclosure activities, and designate a special person to handle matters related to information disclosure activities. For the information that has been published, an information publication file shall be established and properly kept. Article 12 An information disclosure obligor shall publish the information of an activity or project before the end of the activity or the completion of the project.
Once the information is released, the information disclosure obligor shall not modify it at will. If it is really necessary to modify it, it shall strictly implement the procedures of the internal management system, re-publish it after modification, explain the reasons, and declare the original information invalid. Thirteenth information disclosure obligors shall truthfully reflect the information disclosure activities in the annual work report, and accept the supervision and inspection of the registration authority. Article 14 The registration authority shall supervise and manage the information release activities according to law, and establish the credit records of information release obligors.
If the information disclosure obligor fails to perform the obligation of information disclosure or publishes false information, the registration administration organ shall order it to make corrections and give administrative punishment according to the provisions of Article 42 of the Regulations.
